Concept of “Limited Government” Is Right-Wing Bunk: Try to Find Anything Remotely Like It in the Constitution

Right-wingers claim the country was founded on “limited government” — It’s totally bogus.

The Cato Institute’s Handbook for Policy Makers says, “The American system was established to provide limited government.” The American Enterprise Institute states its purpose to “defend the principles” of “limited government.” The Heritage Foundation claims its mission is to promote “principles of … limited government.” A multitude of Tea Party associations follow suit.

At first glance the concept of “limited government” seems like a no-brainer. Everybody believes the power of government should be limited somehow. All those who think totalitarianism is a good idea raise your hand. But there is one problem with the ultra-conservatives’ “limited government” program: it is wrong. It is not just a little bit wrong, but demonstrably false.

The Constitution was never intended to “provide limited government,” and furthermore it did not do so. The U.S. government possessed the same constitutional power at the moment of its inception as it did yesterday afternoon.

This is not a matter of opinion, but of literacy. If we want to discover the truth about the scope of power granted to federal government by the Constitution, all we have to do is read what it says.

The Constitution’s grant of essentially unlimited power springs forth in its opening phrases: “We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”

As might be expected in a preamble to a founding document, especially one written under supervision of arch-aristocrat Gouverneur Morris, the terms are sweeping and rather grandiose. But the point is crystal clear: “to form a more perfect Union.” If the object of the Constitution were to establish “limited government,” its own Preamble must be considered a misstatement.

Enumerated Powers

Article I establishes Congress, and Section 8 enumerates its powers. The first clause of Article I, Section 8 repeats the sweeping rhetoric of the Preamble verbatim. While it provides for a measure of uniformity, it does not so much as hint at a limit on the federal government’s power to legislate as it sees fit:

“The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States…”

No attempt is made here, or at any other place in the Constitution, to define “general Welfare.” This oversight (if that is what it was) is crucial. The ambiguous nature of the phrase “provide for the…general Welfare” leaves it open to widely divergent interpretations.

Making matters worse for federal government power-deniers is the wording of the last clause of Article I, the so-called “Elastic Clause”: Congress shall have power “To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.”

Thus the type, breadth and scope of federal legislation became unchained. When viewed in light of the ambiguous authorization of the Article’s first clause, the importance of the “necessary and proper” clause truly is astonishing. Taken together, these clauses – restated in the vernacular – flatly announce that “Congress can make any law it feels is necessary to provide for whatever it considers the general welfare of the country.”

Lately there has been an embarrassingly naïve call from the Tea Party to require Congress to specify in each of its bills the Constitutional authority upon which the bill is grounded. Nothing could be easier: the first and last clauses of Article I, Section 8 gives Congress black-and-white authority to make any law it so desires. Nor was this authority lost on the Founders.

Limited government” advocates are fond of cherry-picking quotes from The Federalist Papers to lend their argument credibility, but an adverse collection of essays called the Anti-federalist Papers unsurprisingly never gets a glance. Here is a sample from New Yorker Robert Yates, a would-be founder who walked out of the Philadelphia convention in protest, written a month after the Constitution had been completed:

“This government is to possess absolute and uncontrollable power, legislative, executive and judicial, with respect to every object to which it extends. … The government then, so far as it extends, is a complete one. … It has the authority to make laws which will affect the lives, the liberty, and the property of every man in the United States; nor can the constitution or the laws of any state, in any way prevent or impede the full and complete execution of every power given.”

Yates, it must be emphasized, took pains to identify the “necessary and proper” clause as the root of the “absolute power” inherent in the Constitution well over a year before ratification.

The Tenth Amendment

A particular darling of secession-prone, far-Right Texas Gov. Rick Perry, the Tenth Amendment is often claimed as the silver-bullet antidote for the powers unleashed by the “general welfare” and “elastic clauses.” Here is the text of the Amendment in its entirety: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Superficially, the Tenth seems to mean “since certain powers are not delegated to the federal government, then those powers are reserved to the states or the people.” This would seem to be good news for champions of limited government. But this is not the case.

The Tenth does not say that important powers remain to be delegated to the United States. It merely says that powers “not [yet] delegated” are “reserved” to the states or the people. This sounds like a terrific idea – until we realize, of course, that all the important powers had already been delegated in 1787, four years before the Tenth Amendment was ratified.

As we have seen, the first and last clauses of Article I, Section 8 made the Tenth Amendment a lame-duck measure even as James Madison composed its words in 1791 – and so it remains today. The sweeping powers “to make all laws necessary and proper” in order to “provide for the general welfare,” had already been bestowed upon Congress. The Johnny-come-lately Tenth Amendment closed the constitutional pasture gate after the horses had been let out.

This apparently has never occurred to the likes of Gov. Rick Perry and his far-Right cohorts who believe a state may reclaim power by withdrawing its consent, in effect repossessing their previously delegated power through state legislation. Superficially, the logic of this position seems sound: if the states had the legal authority to delegate power, then they may use the same authority to “un-delegate” it by law.

But a close re-reading of the Tenth’s wording nixes such reasoning. Oddly, the Tenth Amendment does not say thestates delegated their powers to the federal government – although it may be argued that it probably ought to have said so. It says “The powers not delegated to the United States by the Constitution … are reserved to the States. …”

Thus, according to the Tenth Amendment, the Constitution itself delegated the power to the federal government. States, in other words, now have no standing to “reserve-back” what they had never “delegated-away” in the first place.

Had it been possible to “un-delegate” the powers of the United States by invoking the Tenth, the Old South would have simply done so and spared itself the bother of secession – not to mention the bother of being annihilated by a series of subsequent Northern invasions. The fact that the South did not even attempt such a strategy attests to the toothlessness of the Tenth Amendment.

No other instance in law would be a better example that we should choose our votes carefully. For in ratifying the Bill of Rights, which included the Tenth Amendment, the American people endorsed the legal fiction that the Constitution – not the original 13 states, or “We the People” – authorized the power of the United States because the Constitution itself said so. If the Constitution has an Orwellian twist, this is it – no matter which side of the aisle you’re on.

The states and the people may amend the Constitution. But they may not do so by nullification (according to the logic inherent in the wording of the Tenth Amendment), or by the judgment of state courts (according to the “supremacy clause” of Article VI), nor may any Amendment be made without the participation of the federal government, itself (according to Article V.) If the Founders had meant to
ensure “limited government,” there is no trace of such intent here.

Paucity of Rights

If the Constitution were intended to provide “limited government,” we might expect it to be chock full of guarantees of individual rights. This is what Tea Partiers may fantasize – but this is not really true. In fact, the Constitution is amazingly stingy in reference to “rights.”

–The word “right” is mentioned only once in the Constitution as ratified. (Art. I, Sec. 8 allows Congress to award copyrights/patents to ensure their holders “… Right to their respective Writings and Discoveries.”)

The word “right” – somewhat counter-intuitively – appears only six times in the ten Amendments called the “Bill of Rights.”

Almost a century later, the first of seven other rights were added under pressure from Progressive activists – almost all of which were intended to create and extend democratic participation in self-government.

–Amendment XIV (sanctions against states denying suffrage); XV (universal male suffrage); XIX (women’s suffrage); XXIV (denial of poll tax); and XXVI (18 year-old suffrage); and twice in Amendment XX, which gives Congress the “right of choice” in presidential succession.

–In grand total, the word “right” appears only 14 times in the entire Constitution, as it exists today (including the two rights conferred to government).

Did we all notice that the “Constitution of the Founders” did not include the “right” for anybody at all to vote? Notable, too, is the absence of language implying that any “rights” are “unalienable” or “natural” or “endowed by their Creator.” All such phraseology belongs to the Declaration of Independence, which – apparently unbeknownst to Tea Partiers everywhere – bears no force of law.

The word “power,” by the way, occurs 43 times in the Constitution, each time referring exclusively to the prerogative of government, not right-wingers. Since “individual” rights are mentioned only 12 times, this yields a ratio of about 4:1 in favor of government power over individual rights. Without the efforts of those pesky, democracy-mongering Progressives, who fought for universal voting rights, the ratio would be more than 6:1 today – or 50 percent higher.

This statistical factoid is not as trivial as it may appear. Expressed in practical terms, Michele Bachmann, Sarah Palin or Clarence Thomas would almost certainly never have achieved public office had they lived under the “limited government” designed by the Founders they so revere.

The Bill of Rights

So what exactly are our non-patent/copyright “rights,” under so-called “limited government?”

–Amendment I – the right of people “peaceably to assemble, and to petition the government for redress of grievances”

–Amendment II – the right “to keep and bear arms, shall not be infringed”

–Amendment IV – the right “to be secure…against unreasonable searches or seizures”

–Amendment VI – the right “to a speedy and public trial”

–Amendment VII – the right “of a trial by jury”

–Amendment IX – enumeration “of certain rights” shall not deny “others retained by the people”

That’s it. What happened to the famous rights of free speech, religion or press? The way the First Amendment is worded does not enumerate these as positive rights that people possess, but rather as activities the government may not infringe upon. If Bill of Rights author James Madison had meant to stipulate them as positive “rights” all he had to do was write it that way, but he did not.

Bear in mind Madison (then a federalist) wrote the Bill of Rights under political duress. Since anti-federalists (recall the skepticism of Robert Yates) flatly refused to ratify the Constitution unless it guaranteed something, Madison had to write something. In effect, the amendments were the pig the anti-federalists had bought in the poke, three years after ratification had paid for it.

Madison, at the time of writing, had little incentive to take pains with what he wrote because federalists did not believe a Bill of Rights was necessary, or even good idea (with Alexander Hamilton arguing a Bill of Rights would be “dangerous.”) This may account for the fact that some of what Madison wrote seems vague, or even ambiguous, as in the case of Amendment II.

Amendment IX, for example, actually makes little sense, which may account for the fact nobody ever seems to mention it: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”

This sounds “righteous” enough, until we recall the Constitution to which this Amendment pertains had “enumerated” only a single right in the first place! Even if Amendment IX applies to the Bill of Rights (to include itself), then all it says is “the people may have more rights than the half dozen mentioned so far, but we’re not going to tell you what they are.” (So if Amendment X is Orwellian, Amendment IX verges on Catch-22.)

Of course the idea was to calm suspicions that people would possess only the half-dozen rights enumerated in the Bill of Rights (plus patents!) and no others. Even so, Amendment IX did not guarantee any un-enumerated rights; it just did not peremptorily “deny or disparage” any.

And what sense should we make of the crucial Amendment V – one of the four Bills of Rights not actually containing the word “right” at all?

“No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor bedeprived of life, liberty, or propertywithout due process of law; nor shall private property be taken for public use, without just compensation.” [Emphasis supplied]

Thus, life, liberty and property are not expressly granted status as fundamental “rights,” but only as personal possessions that may be deprived or taken according to “due process.” The crucial implication is that Amendment V exists in order to stipulate how the government may deny an individual claim to life, liberty or property. With due process, you life, liberty and property may be toast. That is what it plainly says.

It is interesting, too, that the Bill of Rights does not speak to the origin of rights, but only to their existence. Moreover, the Constitution never speaks of granting rights, but only protecting them. There is a good reason for this: excepting the Progressive suffrage Amendments, none of the guaranteed rights were American inventions, but had for centuries been considered the rights of the English nobility.

For those who want to believe in “American Exceptionalism” as the basis of “limited government,” this is not encouraging news. Moreover, the Constitution, including the Bill of Rights, hardly includes any “right” that had not already been recognized at one time or another by medieval English monarchs or in ancient Rome and Greece.

Property Rights and ‘Republic’

The strict libertarians among us claim the sole legitimate power of government is that which is necessary to protect private property rights. On this score, however, the “limited government” of the Founders is practically mute. Except for the aforementioned Article I, Section 8 provision for patents and copyrights, private “property” is only mentioned twice in the Constitution, both times in a single sentence of the “right”-less Amendment V quoted above:

“No person shall … be deprived of life, liberty or property without due process of law; nor shall private propertybe taken for public use, without just compensation.” [Emphasis supplied]

Once again, Amendment V fails to guarantee personal immunity from the power of the state, but rather details the way state power may be used to dispossess individuals of their property. And we must bear in mind these words were not penned by Marxists, socialists, or Progressives.

Whether by design or happenstance, the original “Constitution of the Founders,” or the Bill of Rights, or even the Constitution with all its Amendments does not grant any irrevocable “right of possession” to property. Even the Second Amendment’s “right to keep” arms, is subject to the terms by which property may be taken under terms of Amendment V, and it always has been.

Tellingly, the word “democracy” does not appear in the Constitution. This intentional oversight is often smugly celebrated by anti-democrats among us, who insist that the United States of America was founded as a “republic.” No doubt this is true, given that the Constitution was written by an exclusive, hand-picked cadre of oligarchs, whose number did not include a single woman, person of color, or wage-earner.

Unfortunately for the pro-republic “limited government” crowd, the Constitution does not contain the word “republic” either. The word does appear as an adjective, but only once, (Article IV, Section 4): “The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them from Invasion…”

Typically for the Constitution, which defines few of its terms, the word “Republican” also remains unexplained. The ambiguity of the term turned out to be handy, however, as Radical Republicans continuously and egregiously violated Article IV, Sec. 4 from 1865-1877 as they enforced blatantly unconstitutional military occupation of former Confederate states during the gross misnomer of “Reconstruction.”

It should be obvious that the “Constitution of our Founders,” including the Bill of Rights, may not protect as many rights as many wish to believe. Moreover, we have already noted the Constitution dropped all revolutionary talk of “unalienable” rights and “Creator endowed” liberty. This was not an oversight.

The revolutionary bit about “consent of the governed” posed an especially delicate problem for the Founders. Almost all owned slaves or were masters of property-less tenants or domestic servants, including their wives – none of whom could offer their legal consent even if they wished to do so. Thus the Founders shrewdly considered it unnecessary to include any voting rights in the new republic they planned to rule, uncontested by the disenfranchised lower castes.

Did this result in the land of the free, with liberty and justice for all? Let’s see.

Under the U.S. Constitution, Americans were sentenced to death for protesting unfair taxes; journalists and citizens imprisoned for criticizing government officials; citizens’ property seized illegally; workers murdered by government agents; thousands jailed without the “privilege” of habeas corpus; entire states deprived of civilian courts; untold numbers of American Indians defrauded of  liberty and property; debt-peonage and debtors’ prisons flourished, as did slavery and child labor; and the majority of the public was denied the vote.

All this was considered constitutional by the Founders. None of these outrages, please note, was the result of “progressivism,” which had yet to be articulated, and all were common prior to the New Deal and the advent of so-called Big Government. Was this the face of “limited government?”

No, it was not. The concept of a democratically “limited government” was not for a moment entertained by our Founders, nor is it by those who idolize them today. With few exceptions, the Founders were Eighteenth Century patricians who took a revolutionary gamble meant chiefly to perpetuate their privileges, free from English colonial overlord-ship. It should come as no surprise these elitists drafted a Constitution that posed no threat to aristocracy.

‘Limited Government’ as Act of Faith

The original Constitution of the United States of America was just so much ink on paper. The Constitution, as it stands today, is just a lot more ink on paper.

But the Constitution’s ink is important and deserves respect because it represents nothing less than the collective civic conscience of the American people. A great many Americans have dedicated their lives in trust to that conscience – on battlefields, in classrooms, in everyday civic life, and even a few in the halls of power.

It is evident that most of the Amendments to the original Constitution – as well as the Supreme Court’s decisions interpreting its scope and purpose – were made because the document had over the course of time been found wanting by the American people, whose common interests it was not originally intended to serve. As the collective civic conscience of the people changed, so too did their interpretation of self-government.

But the entire concept of social evolution (much less biological evolution) is something the ultra-Conservative rank-and-file likely does not comprehend and it is not something their leaders encourage them to consider. The reason for this may have less to do with politics than with fundamentalist faith.

An anecdote in point: the editor-in-chief at Random House once asked the extremist libertarian Ayn Rand if she would consider revising a passage in one of her manuscripts. She reportedly replied, “Would you consider revising the Bible?”

Ergo, that which is sacrosanct neither requires nor will tolerate change – to include the fantasized “limited government” of the immortalized “Founding Fathers.” The fact that Rand was a noted atheist only underscores the point that fundamentalist faith is not restricted to any particular brand of fanaticism.

Yet the Constitution’s conception was anything but immaculate. It was not carted down from the Mount in tablets of stone, nor is it the product of some mysterious Natural Law interpretable only by libertarian gurus. And whether its meaning is best exemplified by the Tea Party flag depicting a talking snake (“Don’t Tread on Me”), perhaps only Eve could judge with authority.

The Constitution is not a holy book, and there is no good reason for anybody to treat it like one. The men who wrote it were not prophets, nor were they particularly virtuous, though some could turn a pretty phrase. In fact, the Constitution’s most unholy-book characteristic is its most welcomed attribute: its readers are not required to believe in its infallibility in order for it to make sense to them.

But we are required to read the Constitution if we want to know what it says. The ultra-conservatives’ obsession with a constitutionally “limited government,” which has never actually existed, suggests they do not understand the Constitution as much as they merely idolize it.

These constitutional fundamentalists – along with the American public in general – would do better to pick the document up and read it sometime, not fall on bended knee before it and expect the rest of us to follow their example.

Poverty in America

The Census Bureau has reported that one out of six Americans lives in poverty. A shocking figure. But it’s actually much, much worse.

Inequality is spreading like a shadowy disease through our country, infecting more and more households, and leaving a shrinking number of financially secure families to maintain the charade of prosperity.

1. Almost half of Americans had NO assets in 2009

Analysis of  Economic Policy Institute data shows that Mitt Romney‘s famous  47 percent, the alleged ‘takers,’ have taken nothing. Their debt exceeded their assets in 2009.

2. It’s Even Worse 3 Years Later

Since the recession, the disparities have continued to grow. An  OECD report states that “inequality has increased by more over the past three years to the end of 2010 than in the previous twelve,” with the U.S. experiencing one of the widest gaps among OECD countries. The 30-year  decline in wages has worsened since the recession, as low-wage jobs have  replaced formerly secure middle-income positions.

3. Based on wage figures, over half of Americans are now IN poverty.

According to IRS data, the average household in the bottom 50% brings in about $18,000 per year. That’s less than the  poverty line for a family of three ($19,000) or a family of four ($23,000).

Census income figures are about 25% higher, because they include unemployment compensation, workers’ compensation, Social Security, Supplemental Security Income, public assistance, veterans’ payments, and various other monetary sources. Based on this supplemental income, the average household in the bottom 50% brings in about $25,000, which is just above the $23,000 poverty line for a family of four.

4. Based on wage figures, 75% of Americans are NEAR poverty.

According to IRS data, the average household in the bottom 75% earns about $31,000 per year. To be eligible for food assistance, a family can earn up to 130% of the federal poverty line, or about $30,000 for a family of four.

Again, Census income figures are about 25% higher because of  SNAP reporting requirements, bringing average household income for the bottom 75% to about $39,000.

Incredibly, Congress is trying to  cut food assistance. Republican Congressman Stephen Fincher of Tennessee referred to food stamps as “stealing.” He added a Biblical quote: “The one who is unwilling to work shall not eat.” A recent  jobs hearing in Washington was attended by  one Congressman.

5. Putting it in Perspective

Inequality is at its ugliest for the hungriest people. While food support was being targeted for cuts, just  20 rich Americans made as much from their 2012 investments as the entire  2012 SNAP (food assistance) budget, which serves 47 million people.

And as Congress continues to cut life-sustaining programs, its members should note that their 400 friends on the Forbes list made more from their stock market gains last year than the total amount of the  foodhousing, andeducation budgets combined.

Mr. Fincher should think about the tax breaks that allow this to happen, and then tell us who’s stealing from whom.”

Everything You Need To Know About Obama’s Gun Violence Prevention Proposals

“In a press conference on Wednesday, President Obama outlined a sweeping effort to prevent gun violence in the United States. Surrounded by children who had written him letters voicing their desire to see gun laws passed, Obama announced that he will sign 23 executive orders and bring a set of proposals to Congress.

The President referenced one child’s letter that read, “I know that laws have to be passed by Congress, but I beg you to try very hard.”

“I promise that I will try very hard,” he said.

Obama also condemned lawmakers who vocally resist any new gun measures, pointing out that the gun policies of Ronald Reagan were more reasonable.

The initiatives cover everything from mental heath, to gun safety, to blocking the most deadly firearms from making it to market. Here are some of the most important efforts the President introduced today:

1. Making background checks universal. Obama wants every single gun owner to go through a proper background check, so it can be determined whether they have a criminal history or diagnosed mental illness. He wants Congress to close the gun show loophole that allows people at gun shows, and private buyers of used weapons, to avoid getting checked. He will also, through executive action, urge private sellers to conduct background checks, even if they aren’t mandatory.

2. Improving state reporting of criminals and the mentally ill. While all states are required to report to the National Instant Criminal Background Check System (NICS) people who should not have access to guns, some states are sluggish about putting the data into the system. Obama will put more money into the hands of the states so that they can improve their reporting systems, and issue stronger guidelines to let states know when they should report people. Obama will also, through Presidential Memorandum, work to make sure agencies are regularly entering data into NICS.

3. Banning assault weapons. This is likely the most difficult battle Obama will undertake. He wants to reinstate the 1994 Assault Weapons Ban, which outlaws military-grade weapons, like the AR-15 used by Newtown gunman Adam Lanza and by Aurora Theater gunman James Holmes. Obama wants Congress to pass the ban, and close some of the loopholes identified in its 1994 iteration.

4. Capping magazine clip capacity at 10 bullets. A military-grade weapon is dangerous, but so are its accessories: Obama proposes banning all extended magazine clips that hold over 10 bullets. Huge magazine clips allow a gunman to fire off hundreds of rounds without having to stop, even once, to reload. The high-capacity magazine ban was also part of the 1994 Assault Weapons Ban.

5. Purging armor-piercing bullets. The sale of armor piercing ammunition has been banned for quite some time, but is still legal to posess such bullets. Obama is calling on Congress to outlaw ownership and transfer of these bullets, instead of just the sale. Those who oppose any gun laws try to spin a ban on armor piercing bullets as a ban on deer hunting ammunition, but such ammo has the ability to penetrate bullet-proof vests, and is more colloquially known as “cop killer bullets.”

6. Funding police officers. Obama wants Congress to reverse its course of austerity for public employees by approving $4 billion to fund police enforcement around the country.

7. Strengthening gun tracking. In order to track weapons that are used for crimes, Obama will issue a memorandum mandating that all agencies trace back firearms. This means that any agency in the country must trace guns used in crimes back to their original owners, as a way to help collect data on where criminal weapons are coming from. Obama will also ask Congress to allow law enforcement to do background checks on guns seized during investigations.

8. Supporting research on gun violence. Obama hopes to be able to gather more information on gun violence and misuse of firearms, and use that data to inform the work of law enforcement. He also wants to restart research, which has been long blocked by the National Rifle Association, on how video games, the media, and violence affect violent gun crimes. The Centers for Disease Control will immediately begin these efforts, but Obama also is calling on Congress to add $10 million to the pot of funding for such research.

9. Encouraging mental health providers to get involved. In order to make sure that those with homicidal thoughts are unable to access the weapons with which to kill, Obama seeks to encourage mental health professionals to alert authorities to such people. He will clarify that doing so is not in violation of patient privacy laws. He also wants to dispel the idea that Obamacare prevents doctors from talking to patients about guns.

10. Promoting safe gun ownership. The administration will start a “responsible gun ownership” campaign to encourage gun owners to lock up their firearms. He will also work with the Consumer Product Safety Commission to make sure safes and gun locks on the market are effective. He’s also calling on the justice department to help him come up with new gun safety technology.

11. Funding school counseling. Obama is calling on Congress to fund the positions of 1,000 news school counselors. The funding will come both through the already-existent COPS Hiring Grant, and through a new Comprehensive School Safety program that Congress will need to sign off on. The latter would put #150 million into funding for new counselors and social workers in schools.

12. Encouraging safe, anti-bullying school environments. Over 8,000 schools could receive new funding — $50 million — under Obama’s plan to encourage safer school environments. Obama wants to help at-risk students by creating a “school climate survey” that will collect data on what services students need, and to remedy any problems by putting professionals into schools. The administration will also issue guidelines on school discipline policies.

13. Recognizing the mental health needs of low-income Americans.Medicaid recipients already qualify for some mental health services, but Obama would like to expand that service so that low-income Americans have the same access to professional help as those who have money to pay for it on their own. Obama will issue a directive to heads of state health programs, enforcing “mental health parity” — the idea that mental health should be treated as a priority as important as physical health.”

What is Medicare?

Medicare is a national social insurance program, (like Social Security) administered by the U.S. federal government since 1965, that guarantees access to health insurance for Americans ages 65 and older and younger people with disabilities as well as people with end stage renal disease. As a social insurance program, Medicare spreads the financial risk associated with illness across society to protect everyone, and thus has a somewhat different social role from private insurers, which must manage their risk portfolio to guarantee their own profit – if not solvency.

A brief history.

In 1965, Congress created Medicare under Title XVIII of the Social Security Act to provide health insurance to people age 65 and older, regardless of income or medical history. Before Medicare’s creation, only half of older adults had health insurance, with coverage often unavailable or unaffordable to the other half. Older adults had half as much income as younger people and paid nearly three times as much for health insurance. (Medicare also spurred the integration of thousands of waiting rooms, hospital floors, and physician practices by making payments to health care providers conditional on desegregation.)

Success

While the USA does not have good results (compared to other industrialized nations) in measures such as average life expectancy and infant mortality, we rank well in the measure of those who reach 65 living until 85.

Medicare administrative overhead costs (2%) are well below the overhead of large companies that are self-insured (5-10%), health insurers offering coverage to small employers (25-27%), and individual insurance (40%). Insurers offering coverage in “Medicare Advantage” plans spend up to 16.7% on profit and overhead.

Who is eligible?

As above, Americans ages 65 and older (who have been legal residents of the United States for at least 5 years ) and younger people with disabilities as well as people with end stage renal disease.

What is covered?

There are four parts to Medicare: types A, B, C, and D.

Part A (hospital insurance) covers inpatient hospital stays (at least overnight), including semiprivate room, food, and tests, and brief stays for convalescence in a skilled nursing facility if certain criteria are met.

Part B (medical insurance) helps pay for some services and products not covered by Part A, generally on an outpatient basis, e.g. doctor visits.

Part C With the passage of the Balanced Budget Act of 1997, Medicare beneficiaries were given the option to receive their Medicare benefits through private health insurance plans, instead of through the original Medicare plan (Parts A and B). As Part C cost the government about 14% more than traditional Medicare, it is being phased out, as per the ACA.

Part D (prescription drug plans)went into effect on January 1, 2006. Anyone with Part A or B is eligible for Part D. Part D is not ‘human friendly’ because it covers prescriptions up to a cost point, then no long covers them until another cost point is reached (the coverage gap or ‘donut hole’). Part D did not allow for negotiation of prescription prices, but this and the coverage gap are addressed in the ACA.

Who benefits from Medicare?

Those eligible above, and their children and/or other family members, as the latter do not have to bear the cost for the care!

How is it funded?

Medicare has several sources of financing. Part A largely is funded by revenue from a 2.9 percent [payroll tax] levied on employers and workers (each pay 1.45 percent). Until December 31, 1993, the law provided a maximum amount of compensation on which the Medicare tax could be imposed each year. Beginning January 1, 1994, the compensation limit was removed. Part B is funded in part by premiums paid by the recipient (about $100/month).

Changes under the ACA.

The Patient Protection and Affordable Care Act (“ACA”) of 2010 made a number of changes to the Medicare program. Several provisions of the law were designed to reduce the cost of Medicare. Congress reduced payments to privately managed Medicare Advantage plans to align more closely with rates paid for comparable care under traditional Medicare. Congress also slightly reduced annual increases in payments to physicians and to hospitals that serve a disproportionate share of low-income patients. Along with other minor adjustments, these changes reduced Medicare’s projected cost over the next decade by $455 billion.

Due to the passage of the ACA Medicare’s unfunded obligation over the next 75 years declined from $13.4 trillion to $3 trillion.

The ACA also made some changes to Medicare enrollee’s’ benefits. By 2020, it will close the so-called “donut hole” between Part D plans’ coverage limits and the catastrophic cap on out-of-pocket spending, reducing a Part D enrollee’s’ exposure to the cost of prescription drugs by an average of $2,000 a year.  Limits were also placed on out-of-pocket costs for in-network care for Medicare Advantage enrollees.  Meanwhile, Medicare Part B and D premiums were restructured in ways that reduced costs for most people while raising contributions from the wealthiest people with Medicare. The law also expanded coverage of preventive services.

What does Medicare Cost us as a nation?

As a share of GDP, Medicare cost is expected to increase from 3.6 percent in 2010 to 5.6 percent in 2035 and to 6.2 percent by 2080. That is, a mere 4% – 6 % to provide health care for our old and disabled citizens.

Why is Medicare Under attack?

This is not an easy point to address from a non-partisian standpoint! If one has as a dogma that no government program can be successful, then counter examples of very successful programs such as Medicare and Social Security are a threat. If one believes that Medicare is a major drain on our finances (it isn’t), then one might view it as an opportunity to cut spending. It revisits the failed privatize Social Security efforts of the last decade. The major causes of our current debut are the reduced tax rates on high incomes, and two wars.

Shock Doctrine at the Post Office: How the GOP Manufactured a Crisis and Too Many Dems Went Along

“Hold one thought in your mind every time you read about the “crisis” the U.S. Postal Service is in: There is a crisis, but it’s a manufactured one. If Congress wasn’t busy applying the Shock Doctrine, the postal service would face a challenge, but one it had time to meet. Instead, we’re being told by Congress and by high-level management at the post office that the crisis is now and that massive cuts are the only answer—that degrading the services the postal service offers will save it.

But before we look at the cuts being proposed, what’s so manufactured about this crisis?

In 2006, the postal service generated a profit. That was the last time it did so, because in late 2006, a lame duck Congress passed the Postal Accountability and Enhancement Act, which among other things forced the postal service to fund its retiree health benefit obligations 75 years into the future, and to do so within 10 years. Taking care of retirees is a good thing, and we’ve seen far too many workers expected to fill the gaps in pensions and health benefits underfunded through no fault of their own. I’m not arguing that the postal service should reverse course so far that it leaves its retirees without health care. But if you needed a single concrete example to demonstrate that this is a manufactured crisis, here it is: Congress put a burden on the postal service that no other government agency or private corporation faces, and when that causes or accelerates problems, it’s taken as evidence of certain doom and the need to make deep cuts. According to Sen. Bernie Sanders, not someone who is going to argue for leaving retired workers in the lurch:

[T]he Postal Service should be released from the “onerous and unprecedented burden” of being forced to put $5.5 billion every year into its future retiree health benefits fund. Sanders’s office explains that “even if there are no further contributions from the post office, and if the fund simply collects 3.5 to 4 percent interest every year, that account will be fully funded in twenty-one years.” At the same time, the senator suggests, the postal service should be allowed to recover more than $13 billion in overpayments it has made to a federal retirement systems.

So the immediacy of the “crisis” the postal service faces is one created by Congress. But there are legitimate long-term challenges, including one in particular we hear a great deal about: the internet. We’re all paying our bills online these days, leading to a precipitous decline in mail sent. Right? Well, there’s another factor no one seems to talk about: the recession. It’s funny when you think about it, because we know how deeply the recession struck the government at all levels, businesses, and individuals. But again and again we’re told that the reason, the reason not a reason, for declining mail is the internet. Yet:

From peak first-class volumes in 2001 to 2007, before the recession began, first-class mail volumes declined from 103.6 billion to 96.3 billion — a total drop of 7%, or just over 1% a year.  From 2007 to 2011, first-class volumes declined from 96.3 billion to 73.5 billion — a drop of 23%, or about 6% a year.In other words, first-class mail has declined by 30% over the past ten years.  About 7% of that 30% happened in the six years before the recession, and the other 23% happened in the four years after the recession began.

The internet should also create possibilities. After all, while people pay their bills there, they also rack up a lot of those bills through online shopping, and someone has to ship those packages. UPS and FedEx don’t serve as many doors as the postal service, and in many cases they contract with the postal service to provide “last-mile” delivery.

For that matter, UPS or FedEx taking a package the last mile can create hassles of its own. I live in an apartment building and work from home. Only our actual mail carrier has a key to the outer door of my building, and I cannot tell you how many times I have gone running downstairs in response to desperate pounding from UPS or FedEx trying to deliver something for the online shopping addict in apartment one. If I didn’t work from home, she’d face what she did one day when I was out—a slip from UPS saying they’d be back between the following hours, and be there if she wanted her package. The stress over how to get a package being delivered during working hours by a private carrier who can’t get into your building is a not uncommon fact of apartment life. Which is to say, it’s not that packages aren’t being carried. They are. Surely there’s an advantage to exploit here somewhere.

But Congress and top postal management aren’t looking for advantages or for growth. They’re looking to cut, supposedly in the name of equipping the postal service for the long haul. However, an analysis (PDF) by the financial advisory firm Lazard, conducted for the National Association of Letter Carriers, notes that:

…one of the Postal Service’s own witnesses at a Postal Regulatory Commission hearing on its network optimization plan recently acknowledged the existence of a study that found that the combined effects of all service cuts under consideration would reduce mail volume by over 10% – an amount which would offset most of the proposed savings from these initiatives.

That means the proposed cuts—no Saturday delivery, longer first-class delivery times, closed processing centers and post offices, and more—would set off a death spiral, with cuts leading to loss of business leading to further cuts. This wouldn’t just affect the postal service, slowing mail delivery and forcing many people in rural areas to drive long distances to get their mail, it would affect the entire economy. We’re talking here about tens of thousands of layoffsthat would disproportionately affect African-Americans and veterans. And cutting that many jobs, especially in concentrated clumps with closing of processing centers, would hit local economies hard.

But that, with the exception of Bernie Sanders and a few other officials fighting to protect the postal service, is where the establishment political discussion is happening. As the Senate debates S. 1789, a bill that would simply put the postal service on a slightly delayed death spiral rather than an immediate one, a number of individual senators have potentially useful proposals, seeking to protect rural mail delivery, the ability to vote by mail in states that rely on that, prescription delivery for senior citizens who may not easily be able to get to the pharmacy, capping postal executive pay—postal executives are paid more like corporate executives, in many cases far more than cabinet secretaries make—and allowing postage prices to be raised beyond the rate of inflation (our first-class postage is cheaper than in most other countries).

There are also proposals for ways the postal service could expand its services. It could potentially return to a postal savings service for the many people who don’t use banks. Sen. Mary Landrieu has suggested the post office could become a place to go for notary publics, copying and handling hunting and fishing license sales. I would love to see fax services at my local post office—the day before tax day, I needed to fax my electronic filing permission. There’s a post office less than a five minute walk from my house, but it doesn’t offer fax services. I had to go to a private packing and shipping store, where I paid $2 a page. Why can’t the post office add fax services and let me pay $2 a page there? In fact, the postal service has tried to expand its services in much larger ways than these, only to be stopped byRepublicans not wanting it to compete with private business. This happened with online bill paying, money transfers, phone cards, postal meter cartridges, and more.

So when the postal service tries to expand its services as a private business could do, it’s stopped by Congress. But operating in the restricted ways it’s allowed, it’s assailed for being an unresponsive money-losing dinosaur. Clearly a number of senators have grave concerns about S. 1789 and are trying to blunt its harm with amendments. But this is a slate that needs to be wiped clean. We need a postal bill that rejects the language of crisis and does not seek to manufacture further crisis. As Lazard notes, “A business plan based on degrading your greatest strength is not likely to be a path to success.” The postal service needs a business plan that expands on its strengths and takes it into new areas of service.

Three Reasons Why It’s Better for the Economy if the Super-Committee Fails to Get a Deal

“Last Thursday’s Washington Post headline blared: “Debt panel’s lack of progress raises alarm on Hill.”

In fact it is far better for everyday Americans if the so-called Super Committee fails entirely to get a deal.

The overarching reason is simple: any deal they are likely to strike will make life worse for everyday Americans — and worsen our prospects for long-term economic growth.

Of course that’s not the view of many denizens of the Capitol who are still obsessed by the notion that it is critical for the Congress to produce a “compromise” that raises revenue and cuts “entitlements.” There are three reasons why these people are wrong:

1). Any deal would likely slash the income of many everyday Americans. You could design a plan to substantially reduce the deficit without big cuts in Social Security, Medicare or Medicaid. My wife, Congresswoman Jan Schakowsky, who served on President Obama’s Fiscal Commission, designed just such a proposal last year. And, of course, Social Security has nothing to do with the deficit in the first place.

Unfortunately, however, in order to get Republican support any large-scale deal in the Super Committee would almost certainly require big cuts in either Social Security, Medicare or Medicaid — or all of them. Substantial cuts in any of these programs will make life harder for everyday Americans and reduce the likelihood of long-term economic growth.

Without a “deal” in the Super Committee, the current budget plan does not cut Social Security, Medicare and Medicaid — and that’s a good thing.

According to the Social Security Administration, the average monthly Social Security check now averages the princely sum of $1,082 — or about $13,000 per year. Next year, for the first time since 2009, payments will increase by $39 per month to offset inflation, but $18 a month of that increase will go right back out the door in the form of Medicare premium increases.

Already under current law, Medicare Part B premiums, that cover services like doctors, outpatient care and home health services, must be set annually to cover 25% of program costs. And remember that Medicare recipients aren’t getting an “entitlement” — they are getting an earned benefit that they paid for throughout their working lives. The same, of course, is true of Social Security.

Mean while, Medicaid is the principle means of assuring that America actually begins to provide health care for all — including nursing home and home care.

The problem with medical care costs isn’t that “greedy” seniors and others are gobbling up too much care. The problem is that the costs of providing care are going up too fast. In fact, the per capita costs of providing health care in America is 50% higher than anywhere else on earth, and the World Health Organization only ranks health care outcomes as 37th, in the world.

Medicare is actually the most efficient means in the American economy for providing health care. Any action by the “Super Committee” that reduces the percentage of Americans on Medicare — say, by raising the eligibility age from 65 to 67 — would cost the American economy.

  • According to a study by the Kaiser Family Foundation, if such a proposal were operational in 2014 it would raise total health care spending in America by $5.7 billion per year.
  • This is so because, while it would save the Federal government a net of about $5.7 billion ($24 billion savings in Medicare payments largely offset by $18 billion of increased Medicaid payments and subsidies to low-income participants in exchanges), it would also generate an additional $11.4 billion in higher health care costs for individuals, employers and states — resulting in a net cost to the economy of $5.7 billion.

The one thing you could do to cut Medicare costs without hurting ordinary families or the economy as a whole is to require Medicare to negotiate with the drug companies for lower prices the same way the Veterans Administration does today. That would cut hundreds of billions in costs to the government over the next ten years, but don’t expect the Republicans to include that as an acceptable cut in “entitlements” as part of a Super Committee deal.

Of course, America has no business cutting the income of seniors who get $13,000 a year in Social Security payments regardless of anything else that is in a deal. The deficit problem should be fixed by asking millionaires and billionaires to pay their fair share and by jobs plans that put America back on a path of sustained economic growth. And we have no business reducing access to health care for everyday people so that CEO‘s can fly around in their corporate jets, oil companies can keep their tax breaks, or Wall Street hot shots — who we all bailed out just three years ago — can pack in their huge bonuses.

Even if a Super Committee proposal includes increases in revenue to the government from millionaires and billionaires, that is not reason that normal people — whose real incomes have dropped over the last decade — should also be called upon to “share in the sacrifice.”

The problem isn’t that everyday Americans are gorging themselves on excesses that “America can’t afford.” The problem is that Wall Street, the financial sector and the 1% have gobbled up all of the increases in economic growth that the country has produced over the last two decades.

That has meant that the standard of living for normal people has been stagnant. But just as problematic, it has lead to a stagnant economic growth. Since the incomes of everyday people haven’t increased at the same rate as increased worker productivity, there simply haven’t been enough new customers to buy the new products and services that American businesses produce. That is the formula for recession and depression. And that’s just what happened.

American corporations are sitting on two trillion dollars of cash. The reason they aren’t hiring has nothing to do with the need for more tax breaks. What stops them isn’t lack of “confidence,” it’s a lack of customers.

For decades the International Monetary Fund (IMF) has preached the need for fiscal constraint and austerity. According to the Washington Post, now even the IMF is warning that, “austerity may trigger a new recession, and is urging countries to look for ways to boost growth.”

If you want to lay a foundation for long-term economic growth in America, the last thing you would do is reduce the income going to ordinary Americans — even over the long run. That’s not the problem — just the opposite. We do not need ordinary people to “share in the sacrifice.” We need policies that will increase the share of income going to ordinary people and reduce the exploding inequality between the 99% and the 1%.

Any deal in the Super Committee will almost certainly do just the opposite.

2.). The worst effects of sequestration could be solved without a “grand bargain”. The one big downside of a failure of the Super-Committee to act would be the level of discretionary spending cuts that would be required through the resulting sequestration. This is particularly true of cuts in education funding.

The budget deal that was struck in order to prevent Republicans from plunging America into default last summer requires an additional $1.2 trillion reduction in the deficit over the next ten years. If the Super Committee fails to agree on the distribution of these cuts, they will automatically be spread over defense and non-defense segments of the budget beginning in 2013. But there would be no cuts in Social Security, Medicare or Medicaid.

Congress would have the ability to adjust these sequestration requirements between now and 2013, regardless. But the “fast track” authority that would require up or down votes on a proposal from the “Super Committee” would expire if the Committee cannot reach agreement by November 23rd.

The best solution to the problem of big cuts in discretionary spending would be to put together a smaller deal to raise some revenue and reduce cuts in discretionary and – if necessary — military spending — after the mandate of the Super Committee has expired.

The Congress will have a year to help solve this problem, and the pressure to ameliorate some of the cuts in military spending that have so far proved ineffective at forcing Republicans to consider big revenue increase, may be more persuasive when it comes to smaller increases as the actual date of sequestration (2013) draws near.

Of course it’s possible that the Super Committee itself could come with a small-bore deal of this sort, simply to avoid the full force of sequestration. But that would be very different than a $1.2 trillion dollar package that includes cuts in Social Security, Medicare and Medicaid. Progressives should avoid cuts to these programs at all costs, because any cuts that sliced Social Security, Medicare or Medicaid benefits would require changes in the structure of the programs themselves that would last forever. Cuts in discretionary spending — as bad as they might be — are one-time events and do not fundamentally change the structure of the American social contract.

3). There is no reason for Congress to fear that its failure to act on a “Super Committee” agreement will have massive adverse consequences on “market confidence,” since the level of the deficit will not be affected. That has already been set — with a mandate for a $1.2 trillion cut. The Wall Street gang and the ratings agencies might sputter something about government dysfunction for a day or two. But the fundamentals will not be affected, since the level of government borrowing won’t be affected by whether or not there is a deal.

It’s also worth noting that even after Standard and Poor’s downgraded the U.S. debt because of the process leading up to the debt ceiling deal, it had no effect on the interest rates the government is paying for bonds. In fact those interest rates dropped to record lows. U.S. government debt remains the safest investment in the world, no matter what S&P did, and the market reflected that indisputable fact.

In other words then, Congress does not have its back against the wall like it did during the debt ceiling “hostage” crisis. When it came to the debt-ceiling deadline, failure was not an option. In the case of the “Super Committee” failure to come to an agreement is a very real option — in fact, it’s the best option.

There are some in Congress — most notably in the Senate — who truly believe that what the country needs is a “grand bargain” that cuts the deficit by making ordinary people “share in the sacrifice” even if millionaires and billionaires are asked to share some as well.

Hopefully those who are working for such bargain will be thwarted by two important political realities.

First, that cuts in Social Security, Medicare and Medicaid are politically toxic. People get really angry when you take away something they have earned.

Second, the Republican’s stubborn unwillingness to give an ounce of new revenue from the pockets of millionaires and billionaires – who, after all, are the true core constituency of the Republican Party.

This time a little “gridlock” may be a good thing.”
